Spousal Support
At the Law Office of Mellin Robinson P.C., we represent individuals and families throughout the Oakland, Wayne and Macomb County area for a variety of divorce-related issues. If you are considering divorce, you may either seek spousal support or your spouse may seek support from you, and in either case it will be important to have assistance from an experienced divorce attorney. Spousal support is financial support paid by one spouse to another.
Not every person going through a divorce will be eligible to receive spousal support (or alimony as it’s also called) or be required to pay. You will need to speak with an attorney at our firm to determine if this option is applicable to your case.
When it comes to determining the amount and duration of spousal support the court considers a broad range of factors. When determining if spousal support is appropriate, the court will consider the length of the marriage, a spouse’s need for financial support, and the ability of the other spouse to pay support.
Spousal support will typically be ordered in the following situations:
- A long-term marriage
- A great disparity in income between the divorcing parties
- If one of the parties is unable to support herself or himself
